Who regulates fall protection in Newfoundland & Labrador

Newfoundland and Labrador's rules are in Part X Fall Protection (ss. 138–146) of the Occupational Health and Safety Regulations, 2012 (NLR 5/12), made under the Occupational Health and Safety Act. The OHS Division of the provincial government enforces them, and WorkplaceNL sets the fall protection certification training standard.

When fall protection is required in NL

S. 141 · S. 29

Fall protection must be provided where a worker could fall from a work area that is:

  • 3 m or more above the nearest safe surface or water;
  • above a surface or thing that could cause injury; or
  • above an open tank, pit or vat containing hazardous material.

Roofs (s. 29): control zones within 2 m of the edge on roofs sloped under 3/12, with fall protection at or within 2 m of the edge, and specific measures for 3/12 to under 6/12, 6/12 to under 9/12, and 9/12 and steeper, such as decked scaffolds, roof brackets with guardrails and toeboards, or fall arrest.

WorkplaceNL fall protection certification

S. 139

A worker must not use fall protection equipment until they have completed the training program prescribed by WorkplaceNL. Under the WorkplaceNL Fall Protection Certification Training Standard:

  • the initial course is 16 hours over two consecutive days, with at most 15 people per class;
  • recertification is at least 8 hours, every 3 years, before the certificate expires;
  • if it lapses, the full 16-hour course must be taken again.

A generic course from outside the province does not meet s. 139.

CSA equipment and rescue in NL

S. 142 · S. 38

As amended in 2022, s. 142 requires CSA Z259.11 energy absorbers and lanyards or CSA Z259.2.2 self-retracting devices, CSA Z259.12 connecting components, and CSA Z259.2.5 vertical lifelines and fall arresters. The OHS Division says equipment without CSA certification, where a CSA standard exists, is not acceptable for use in the province, and officers will remove it from service.

Written rescue and evacuation procedures are required for work at high angles (s. 38(3)). Safety belts are not permitted for fall protection.
